In Belgium, the principle is that gambling is prohibited unless it is expressly authorised. Because, in the past, an outright ban led to a proliferation of illegal games of chance, the Legislator opted for a policy to channel games of chance with licences.
The Gaming Commission (GC) grants various types of licences for operating games of chance, in order to provide an effective framework for these games.
In order to retain their licence, licensed operators must comply with the legal and regulatory provisions. If an operator violates the Gambling Act, the GC can impose an administrative penalty. This can range from a warning to the suspension of the operation of some machines for a certain duration, and even the withdrawal of the licence.
